Terms of Service

By accessing or using DumpsterAIFlow (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

If you do not agree to these Terms, do not use the Service.

These Terms apply to all users of DumpsterAIFlow, including dumpster rental operators, their staff, and end customers who interact with the booking system.

DumpsterAIFlow provides a software-as-a-service platform ("SaaS") that enables dumpster rental businesses to:

• Automate customer quote requests and online bookings.
• Recover missed calls through automated SMS text-back functionality.
• Accept deposits and payments through an integrated booking checkout.
• Manage and review orders through a business dashboard.

The Service is provided on a subscription basis. Features may vary depending on your plan.

To use DumpsterAIFlow, you must create an account by providing accurate, current, and complete information.

• Keep your account credentials secure and confidential.
• Notify us immediately at support@dumpsteraiflow.com if you suspect unauthorized access to your account.
• Ensure all information you provide is accurate. You are responsible for any activity that occurs under your account.
• You may not share your account with other businesses or individuals.

We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

DumpsterAIFlow charges a one-time setup fee and a recurring monthly subscription fee.

Setup Fee: A one-time fee is charged at the time of onboarding and covers platform configuration and integration into your business.

Monthly Subscription: Billed on the same date each month, automatically charged to your payment method on file.

Payment Processing: All payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method for all fees.

Failed Payments: If a payment fails, we will attempt to charge your payment method again within 3 days. After two failed attempts, your account may be suspended until payment is resolved.

Refunds: Setup fees are non-refundable. Monthly subscription fees are non-refundable for the current billing period. If you cancel mid-period, you will retain access until the end of the period. See our cancellation policy below.

Price Changes: We will provide at least 30 days' notice before changing subscription pricing. Continued use after the notice period constitutes acceptance of the new pricing.

You may cancel your DumpsterAIFlow subscription at any time from your account dashboard or by contacting support@dumpsteraiflow.com.

• Your account remains active until the end of your current billing period.
• You will not be charged for the following billing period.
• Access to the platform and all associated features will be disabled at the end of the billing period.
• Your data will be retained for 90 days post-cancellation, after which it will be permanently deleted.

We reserve the right to cancel your account and terminate service immediately if you violate these Terms, engage in fraudulent activity, or fail to pay outstanding fees.

You agree to use DumpsterAIFlow only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to engage in any illegal activity or violate any applicable law.
• Send spam, unsolicited marketing messages, or abusive communications through our SMS features.
• Attempt to gain unauthorized access to our systems, networks, or other users' accounts.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Resell, sublicense, or transfer access to the Service to any third party without our written consent.
• Upload or transmit viruses, malware, or any other harmful code.
• Use the Service to process bookings for illegal goods or services.
• Impersonate DumpsterAIFlow, its employees, or other users.

Violation of this policy may result in immediate suspension or termination of your account without refund.

You retain full ownership of the customer data processed through DumpsterAIFlow (your customers' names, phone numbers, addresses, booking history, etc.).

By using the Service, you grant DumpsterAIFlow a limited license to process that data solely for the purpose of providing the Service to you.

• You are responsible for obtaining any necessary consents from your customers for booking, SMS communications, and marketing.
• You must comply with applicable data protection laws (including TCPA regulations governing SMS messaging) when using our automated communication features.
• You are responsible for ensuring your use of our SMS features complies with carrier guidelines and opt-out requirements.

DumpsterAIFlow will process your customer data in accordance with our Privacy Policy and as a data processor acting on your instructions.

DumpsterAIFlow and its licensors own all intellectual property rights in the Service, including but not limited to software, algorithms, interfaces, logos, trademarks, and documentation.

These Terms do not grant you any ownership rights. You receive only a limited, non-exclusive, non-transferable license to use the Service during your active subscription.

You may not copy, reproduce, modify, or create derivative works of our platform, branding, or content without our prior written consent.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

• The Service will be uninterrupted, error-free, or completely secure.
• Any information provided through the Service will be accurate or reliable.
• The Service will meet your specific business requirements.

We are not responsible for your customers' booking decisions, payment disputes between you and your customers, or any business outcomes resulting from your use of the platform.

Uptime: We target 99.5% monthly uptime. Scheduled maintenance will be communicated in advance where possible.

To the fullest extent permitted by applicable law, DumpsterAIFlow shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, customers, or business opportunities.
• Data loss or corruption.
• Damages resulting from your use of or inability to use the Service.

In all cases, DumpsterAIFlow's total cumulative liability to you shall not exceed the amount you paid to us in the 3 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

You agree to defend, indemnify, and hold harmless DumpsterAIFlow, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, and expenses (including reasonable legal fees) arising from:

• Your violation of these Terms.
• Your use or misuse of the Service.
• Your violation of any third-party rights, including intellectual property rights.
• Any content or data you process through the Service.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Dispute Resolution: We encourage you to contact us first at support@dumpsteraiflow.com for any disputes. We will make every reasonable effort to resolve issues informally within 30 days.

If a dispute cannot be resolved informally, both parties agree to submit to binding arbitration in accordance with the American Arbitration Association's Commercial Arbitration Rules. The arbitration will take place in Delaware, and the arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis only, not as a class or representative action.

We may update these Terms at any time to reflect changes in our Service, legal requirements, or business practices.

• Update the "Effective Date" at the top of this page.
• Send an email notification to all registered account holders at least 14 days before changes take effect.

Your continued use of the Service after the effective date of updated Terms constitutes your acceptance. If you do not agree to the changes, you may cancel your subscription before they take effect.
